The TCPA, aka Telephone Consumer Protection Act, is a federal law that regulates telemarketing and other forms of electronic communication. The TCPA prohibits sending unsolicited text messages to wireless numbers unless the recipient has given prior express consent.

There are a few exceptions to the TCPA’s consent requirement. For example, real estate professionals can send text messages to people who have previously done business with them, or to people who have explicitly opted in to receive text messages.

However, majority of real estate investors using text message marketing are doing this without prior consent, or previous contact, to send homeowners the "Looking to offload your home at 123 Main St?" message.
